Scope of the Terms and Conditions

The scope includes all activities of Airqigong GmbH, such as courses, workshops, training sessions, retreats, events, and any other contractual agreements related to the business activities of Airqigong GmbH.

Airqigong GmbH primarily provides paid services in the field of Qigong. These Terms and Conditions apply to the purchase of any services by participants, whether obtained digitally or physically (via internet, mobile, on-site courses, etc.) from Airqigong GmbH. Participants are natural or legal persons who use services provided by Airqigong GmbH or have registered with Airqigong GmbH for such services. By using one or more services, the participant irrevocably agrees to the application of these T&C.

General

Registration and Implementation

By the latest, after registration and the implementation of all activities and services, the following Terms and Conditions are considered legally binding and accepted and approved by the participant.

Changes 

Changes to these Terms and Conditions are generally excluded and will only take effect if they are agreed upon in writing in the case of differing special agreements. Any such agreed changes to the Terms and Conditions are only valid for the specific legal transaction and explicitly not for subsequent transactions.

Scope of services

The services include the implementation of Qigong activities and services both domestically and internationally. Airqigong GmbH, as well as the teaching staff, take responsibility for the proper implementation of the courses, events, and workshops in accordance with the statutory warranty provisions. Any liability beyond this, particularly under the title of damages, is expressly excluded.

Payment Terms and Cancellation Policy

• Paid block cards cannot be refunded after purchase. Block and time cards are valid from the indicated validity date and expire after their validity date. They are personal and non-transferable.

• Paid time cards can be refunded up to 90 days after the purchase date, but no later than 7 days before the validity date ("Valid from").

• Paid workshops and retreats can be canceled by the participant free of charge up to a maximum of 90 days before the scheduled date. In the event of a trip cancellation, a refund is excluded. The participant has the option to name a substitute participant. This must occur simultaneously with the cancellation. A processing fee of CHF 100.- will be charged, as well as any rebooking costs. The participant is responsible for obtaining travel cancellation insurance and international health insurance. 

Registration and Cancellation Policy

• Registrations for all Airqigong GmbH offerings are legally binding with the corresponding registration confirmation. The cancellation terms for all activities are visible in the online reservation system at the time of purchase and are legally binding. Cancellations must be made by the participants themselves through the online reservation system. Cancellations made through other communication channels such as Instagram, phone, or email cannot be considered.

• For late cancellations or no-shows to the reserved Qigong activity, the fee will be charged without notice. Non-payment of an invoice does not constitute a cancellation.

• Changes to the schedule or teaching staff can occur at any time. Program changes as well as changes to individual services (venue, travel companion, instructor, means of transport) due to unforeseeable circumstances or safety reasons are expressly reserved and hereby acknowledged by the customer. There is no right to a refund.

• Pauses of block and time cards due to holiday absences or work reasons are excluded. In the case of illness or accident, the duration of block and time cards can be paused upon presentation of a medical certificate, provided that no services were used during the confirmed period.

Entry Formalities 

Swiss passport or identity card must be valid at least until the return date. We recommend that citizens of other countries inquire about the entry formalities at the consulate or embassy of the destination country. We advise ensuring that your passport is valid for at least 6 months beyond the return date. Compliance with entry regulations is the responsibility of the customer. Please note that Airqigong GmbH will not assume any liability for non-compliance with regulations and the associated expenses, such as in the case of denied entry. Please stay informed about any changes to the regulations until your departure. 

Disclaimer of Liability

It is the participant's responsibility to have adequate insurance coverage. Airqigong GmbH expressly disclaims any liability for damages suffered by participants. This means that no responsibility is assumed for damages or injuries resulting from participating in Qigong activities, workshops, or other services. In particular, Airqigong GmbH is not responsible for physical or mental health problems that may arise or worsen from attending events or workshops. If there are doubts about physical or mental suitability for participation, it is strongly recommended to seek medical advice before registering.

Airqigong GmbH is not responsible for the loss or theft of personal belongings of participants.

Participants are required to inform the instructor at the beginning of the course, workshop, or event of any existing physical or mental health limitations as well as any existing pregnancy. If a health limitation arises during the activity, it must be reported to the instructor immediately.

The instructor reserves the right to refuse potential participants if the health or psychological well-being of the person is not suitable for participation in the course. This decision can be made at short notice or even during ongoing courses. If a person is refused, a pro-rata refund of the course fee will be issued.

Data Protection

Airqigong GmbH undertakes to treat personal data and information confidentially and not to disclose it to third parties. Exceptions include the sharing of data with employees of Airqigong GmbH and business partners for organizational reasons. Participants are also obliged to treat information about other course participants confidentially.

Airqigong GmbH uses photos and videos from courses and events on its website or on social media, where participants may be recognizable. Should this happen against a person's will, they can instruct the service provider to remove their likeness from the image. No further claims can be made.

Trademark Protection

The word and design mark of #AirQIGONG® is legally protected. If a third party uses the trademark without the express, written consent of Airqigong GmbH, it constitutes a trademark infringement. Any imitations are considered a violation of copyright and will be prosecuted and subject to damages.
